Here Xavier Belvaux, director of We Invest France, answers a question from Manuel, a member of the Owners Club, a Facebook group managed by Capital. Landlord Manuel is confronted by a tenant who refuses to provide him with proof of home insurance. Does he have the right to require home insurance from the tenant? If so, by what legal means does Manuel have to force him to comply?

Xavier Belvaux immediately points out that, as the owner, Manuel has the right to require this certificate, which is mandatory for every lease. This guarantees that the tenant is insured during the period of use of the rented accommodation. In case of refusal, and by registered mail with confirmation of receipt, Manuel can remind his tenant of the contractual obligation to provide the said certificate. In rare cases where the tenant persists in not providing proof, Manuel can go even further by including financial penalty clauses in the lease in the event of the tenant not complying with their obligations.
